Settlement Hearing in Foodarama Supermarkets, Inc. Class Action to be Held on July 16, 2008 at 9:00 a.m.
PHILADELPHIA, May 15 PRNewswire — The law firms of Cohn Lifland Pearlman Herrmann & Knopf LLP; Berger & Montague, P.C.; and Harold B. Obstfeld, P.C. in the Foodarama Supermarkets, Inc. class action lawsuit, announced the following:
SUPERIOR COURT OF NEW JERSEY CHANCERY DIVISION, MONMOUTH COUNTY SUMMARY NOTICE OF CLASS ACTION, PROPOSED SETTLEMENT, HEARING, AND RELATED MATTERS
TO: ALL PERSONS AND ENTITIES who tendered or otherwise relinquished by operation of law shares of common stock of Foodarama Supermarkets, Inc. in or after July, 2006 at $53 per share as a result of the going-private transaction.
YOU ARE HEREBY NOTIFIED that a hearing will be held on July 16, 2008, at 9:00 a.m. before the Honorable Thomas W. Cavanagh, Jr., at the Superior Court of New Jersey, Monmouth County, Chancery Division, Hall of Records, 1 East Main Street, Freehold, New Jersey 07728-1266, to determine whether an Order should be entered: (i) certifying the Class for settlement purposes; (ii) finally approving the proposed settlement of the class action claims asserted by Plaintiff against defendants in this action in exchange for a payment of $6,900,000, and on the other terms set forth in a Settlement Agreement dated April 4, 2008 (the "Settlement"); (iii) dismissing this action with prejudice; and (iv) awarding fees and reimbursement of expenses to counsel for Plaintiff and the Class.
