American Traffic Solutions Files Motion to Dismiss Texas Lawsuit
SCOTTSDALE, Ariz.-(Business Wire)-December 23, 2008 - On Friday, December 19, 2008, American Traffic Solutions, Inc. filed a motion to dismiss a federal lawsuit brought by Texas plaintiffs who violated the red-light traffic laws and are seeking a return of the fines paid for their traffic tickets. The lawsuit claims that photo enforcement vendors operating in Texas must first obtain private investigators’ licenses.
“The claim has no merit and can only be considered frivolous,” said George Hittner, Vice President and General Counsel of American Traffic Solutions. “The Private Security Bureau of the Texas Department of Public Safety, which is the Texas agency statutorily authorized to regulate private investigators’ licenses, has already issued an opinion confirming American Traffic Solutions’ position that red-light camera vendors do not require a private investigator’s license to operate in Texas.”

Note: A separate case against a different red-light camera company, Dallas-based Affiliated Computer Services, Inc. (ACS) was filed earlier this year in Texas State Court in Dallas. The proceedings of the on-going ACS litigation matter are separate from those now underway in Federal Court in which ATS is a party.
